Is there anything "legal" that allows a dealer to refuse to work on an unsafe car that a customer refuses to repair?

In the example above, even after the recall is complete, the car will still be unsafe to drive. I'm sure you have all your bases covered with documenting the customer's declined repairs but at what point does it become unsafe or liable to even touch the car?

We had an incident years ago..a recall on the seat belts of mid 90's corsicas. I was the advisor that greeted the customer and her grand kids. She walked out of the car and I was bowled over with a stench that made me step back about 10 yards. She went to the waiting room whilst the service manager and I looked into the car. There was feces smeared into the backseat where the kids were sitting, food decomposing in the floorboard, old diapers, and roaches all over. We came to the conclusion that we were not exposing our techs to that biohazard...even on a recall.

I had to go to the guest lounge to inform her of our decision. People were leaving the area. The kids, still covered in sh!t, were rolling on the floor, the ladies pee stained panties hung below her skirt while sitting. It was so revolting. I told her that in order for us to perform the recall she must have the car disinfected and all the debris removed for our technician's safety. She never came back.

I believe you do have some leg to stand on if, and only if, the car is in such dire shape that operation of it on your lot could cause harm.

Years ago we has a Buick Somerset (like I said years ago) came in customer complaining of brake noise. Customer wanted tech to go on test drive with her. As he walked around car could see the front rotors were ground down to the cooling fins. SA told her car was not safe to drive. She left it with us, we parked out back and called her with estimate. Stated it was to high and she would come in and get car. We told her she could not drive it in the condition it was in. She said her lawyer would call us the next day and hung up. That night she came in with another set of keys and took car. She never returned for her keys and lawyer never called.

We do not cut keys until the vehicle is here. Vehicles get wrecked. Things happen. Before the vehicle comes we do retrieve key codes and cuts to speed the process along once they come in for service.

We have 15 scheduled for today trying to get codes so when the tech comes up we are ready, one advisor cannot kets codes anymore, he did 5 right in a row and now the screen says he didn't log off correctly wait 3 minutes. He never logged off in the first place now my log on is running VERY slow on the key code site.
Update: waited 5 minutes and he still cannot get codes, logged off and back in gets same message.

Remember they are working with us to achieve customer satisfaction at this diffuclt time :lol:

Our techs do all the cylinder coding. I need to buy them lunch.

Only way we cut keys is when the car arrives. Our service advisors are instructed to tell the customers they must bring both keys. We've had a few errors with key cutting. On more than on occasion we told the customer they only brought us one key so we only gave them one key. We do normally give them two keys but when we only have one to hand out thats all they get. We tell them to bring us the other key and we will give them the second key. I know it's not ideal but it has gotten us thru.
